The Importance of Timely Paying Arbitration Fees/Costs

Can untimely payment of arbitration fees or costs lead to a loss of the right to arbitrate? Last month, the Second District Court of Appeal published a decision addressing this issue. To find out what they decided, watch the video and read my case summary below.

New CA Arbitration Decision  

De Leon v. Juanita's Foods (2022) _ Cal.App.5th _ , 2022 WL 17174498: The Court of Appeal affirmed the trial court’s order, after the commencement of arbitration proceedings between plaintiff and defendant, concluding that defendant materially breached the arbitration agreement when it failed to pay its share of the arbitration fees within 30 days after they were due, and allowing plaintiff to proceed with his claims against defendant in court. The Court of Appeal concluded that the trial court correctly ruled that defendant was in material breach of the arbitration agreement. (Code of Civil Procedure, sections 1281.97(a)(1); 1281.98(a)(1).) (C.A. 2nd, November 23, 2022.)
